Ethical Code

Drafting a corporate ethical code is a voluntary act by the company, expressing a set of behavioral norms that its members must follow. At ARKON Omnia, a professional associate studio where colleagues collaborate in the same profession but with different expertise, the ethical code is fundamental.
In the business realm, the absence of ethical consideration in actions may lead to "potentially opportunistic" behaviors, driven by the mistaken belief that they are benefiting the organization. Therefore, the importance of an ethical code lies in reaffirming that the belief of acting in the organization's interest can never justify behaviors that conflict with shared principles and values. The document that follows is not intended to enhance ARKON Omnia's legal compliance or reputation, as legal responsibility, adherence to laws, and fairness—like the quality of services—are essential conditions for the studio's existence and cannot be considered objectives of an ethical code.
The primary goal of the ethical code is to share and promote the values that the studio identifies with, ensuring that anyone making a decision clearly remembers that what is at stake is not only their own interests, rights, and duties but also those of others. In other words, everyone should be aware that the well-being and respect for all must always and explicitly be taken into consideration at every stage of daily activities.
Honesty and Transparency

Honesty represents a fundamental principle for all activities of ARKON Omnia, its initiatives, services, reports, and communications, and constitutes an essential element of the studio's management. Relationships with clients and stakeholders at all levels must be based on fairness, consistency, loyalty, and mutual respect.

ARKON Omnia believes that to qualify as ethically responsible, its entrepreneurial activity must pursue models that respect and safeguard human rights, the Earth's regenerative capabilities, and community well-being. It promotes equitable and sustainable human development, aware that social and ethical responsibility extends to communities.

DATA CONTROLLER: IDENTITY, CONTACT DETAILS, AND REPRESENTATIVE
The data controller, under Regulation (EU) 2016/679, is ARKON Omnia, with offices at P.za C. Colombo, number 9, Fubine (AL) 15043 – Italy. Contact details can be found on the corporate website www.arkonomnia.it and are as follows:

DATA PROTECTION OFFICER
A data protection officer (DPO) has not been appointed as it is not required under Article 37 of the Regulation.

PURPOSES OF DATA PROCESSING
Data is processed for the following purposes:

  • To fulfill the agreement with the client and execute and respect its civil, tax, social security, or contractual obligations.
  • To comply with legal obligations of the data controller.

LEGAL BASIS FOR PROCESSING
The legitimacy of data processing is based on one or more of the following elements:

  • Explicit consent from the data subject.
  • The necessity of processing to perform the agreed service between the controller and the subject.
  • The necessity of processing to fulfill the controller’s civil, tax, and social security obligations.

LEGITIMATE INTERESTS OF THE CONTROLLER OR THIRD PARTIES
Neither the controller nor third parties pursue interests beyond the previously stated purposes of the data processing.

RECIPIENTS OF PERSONAL DATA
The processed data may be sent to:

  • Public administrations to fulfill legal obligations arising from the contract between the controller and the client or specific obligations for the controller.
  • ARKON Omnia (based in P.za C. Colombo 9, Fubine – AL – Italy) for professional consultancy necessary to meet the legal and contractual obligations of the controller and client.
  • Third parties necessary to execute the contract between the controller and the client.
  • Cloud service providers offering part of the IT infrastructure, digital storage services, and data backup services. These providers are selected among the most reliable and reputable national and international IT service providers (e.g., Microsoft Corporation).

DATA TRANSFER TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS

  • The controller does not directly transfer data to third countries or international organizations.
  • Cloud providers may store data in their data centers, which may be located in third countries.
